This EU-UK Privacy Policy (this “EU-UK Privacy Policy”) supplements (and in the case of conflict, takes precedence over) the general Privacy Policy, if and only to the extent that EU-UK Data Protection Legislation (as defined below) applies to our processing of your personal data in connection with this website. Information required to be disclosed under EU-UK Data Protection Legislation regarding the processing of your personal data that is not set forth in this EU-UK Privacy Policy is otherwise set forth in the general Privacy Policy above. If this EU-UK Privacy Policy applies, you have certain rights with respect to such personal data, as outlined below.
For this EU-UK Privacy Policy, “EU-UK Data Protection Legislation” means all applicable legislation and regulations relating to the protection of personal data in force from time to time in the European Union (“EU”), the European Economic Area (“EEA”), the United Kingdom (“UK”), or the Cayman Islands, including the EU GDPR and the UK GDPR, and the terms “data controller,” “data processor,” “data subject,” “personal data” and “processing” in this EU-UK Privacy Policy shall be interpreted in accordance with the applicable EU-UK Data Protection Legislation. For the purposes of applicable EU-UK Data Protection Legislation, Todd and/or one or more of its affiliates will be the controller of any personal data collected by us.
This EU-UK Privacy Policy does not apply to any processing of personal data by or on behalf of Todd that is covered by a more specific privacy policy (including, without limitation, our employee and contractor privacy policies and our Service and/or Product User Agreement’s privacy policies).
Please direct any questions arising out of this EU-UK Privacy Policy, please contact contacttodd.us@todd.com.
Our general Privacy Policy sets out the personal data that we collect (as described in the section headed “THE INFORMATION WE COLLECT AND HOW WE USE IT”). We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership or information about your health or genetic or biometric data).
We rely on various legal bases under the EU-UK Data Protection Legislation in order to process your personal data, including our legitimate interests, contractual necessity, and as required by law. We use the personal data we collect to operate our business and perform essential business operations and provide you with the services and products we offer.
If we require your personal data due to a legal requirement or obligation or in order to perform a contract with you, we will make you aware of this at the time we collect your personal data, and the possible consequences of you failing to provide this personal data. Failure to provide this data means that we cannot provide our services or products to you. In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.
Note that we may process your personal data on more than one legal basis depending on the specific purpose for which we are using your personal data.
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so.
No automated decision-making, including profiling, is used when processing your personal data.
Disclosure and Transfer of Personal Data If collected, your personal information may be shared with and processed by our affiliates, agents, and certain service providers, as necessary, to fulfill the purposes set out this Privacy Policy, including professional advisors and data hosting providers.
Our website contains links to other websites which are not hosted or operated by us. These websites may use automated means to collect information regarding your use of the websites. This information is subject to the privacy policies or notices of the provider’s website.
We reserve the right to disclose your personal information as required by law or legal process, or when we believe that disclosure is necessary or appropriate to protect our rights, prevent physical harm or financial loss, and/or comply with a judicial proceeding, court order, request from a regulator, national security, for the purposes of public importance or any other legal or investigatory process involving us. Should we, or any of our affiliated entities, be the subject of a takeover, divestment or acquisition, or otherwise sell or transfer all or a portion of our business or assets (including in the event of a reorganization, dissolution, or liquidation), we may disclose your personal information to the new owner of the relevant business and their advisors on the basis of our legitimate interest.
Our general Privacy Policy sets out details of any personal data transfers (as described in the section headed “DISCLOSURE AND TRANSFER OF PERSONAL DATA”). To the extent any personal data is transferred from the EEA or UK to a destination outside the EEA or UK, we will take steps to ensure that your personal data is protected by appropriate organizational and security measures, and that any such transfers are only made in accordance with the EU-UK Data Protection Legislation (which may include implementing the EU standard contractual clauses and/or the UK International Data Transfer Addendum).
For further information about the safeguards or details of any relevant non-EEA/UK countries, please contact contacttodd.us@todd.com.
Todd and its affiliates consider the protection of personal data to be a sound business practice, and to that end, employ appropriate technical and organizational measures, including robust physical, electronic and procedural safeguards to protect personal data in their possession or under their control.
Personal data may be kept for as long as it is required for legitimate business purposes, to perform contractual obligations or, where longer, as long as is required to comply with applicable legal or regulatory obligations. Personal data will be retained throughout the life cycle of any investment in an applicable fund managed by Todd. However, some personal data will be retained after a data subject ceases to be an investor in such fund.
We may send you direct marketing communications where we have obtained your prior consent to keep you informed of our products and services in which you might be interested, or where we have an existing relationship with you and we wish to contact you about similar products or services in which you may be interested.
You have the right to ask us not to send you marketing communications. You can also let us know at any time that you wish to change your mind and to start receiving such communications. You can do this:
• by replying directly to the marketing communication; or
• at any time by contacting us (see the section headed “CONTACT US” above).

Please note that the right to erasure is not absolute, and it may not always be possible to erase personal data on request, including where the personal data must be retained to comply with a legal obligation.
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
You may raise any request relating to the processing of your personal data with Todd by contacting us at contacttodd.us@todd.com.
